The petitioner in the present case is the respondent in HMP No. 384 of 2014 before the Joint Civil Judge, Junior Division, Sangli. The respondent herein had filed a petition for restitution of conjugal rights. By way of ad-interim relief, the respondent was granted interim maintenance of Rs. 4,000/- per month and Rs. 6,000/- towards the cost of the proceedings.

The learned Counsel appointed by this Court for the respondent has submitted that the main Petition i.e. HMP No. 384 of 2014 has been decreed in favour of the respondent. The Petitioner has also filed petition for divorce.

16.wp1582.16.doc Be that as it may, in any case, the Petition challenging the grant of interim maintenance would become infructuous since main proceedings are quashed. In view of this, no order as to costs. The petition stands disposed of.

Learned Counsel Ms. Rushita Jain is appointed by this Court to espouse the cause of the respondent. She is entitled to the professional fees as per rule to be paid by the High Court Legal Services Committee within 3 months from today.
