Learned Counsel for the applicant upon instructions seeks liberty to withdraw the application. Liberty as prayed for is granted in the interest of justice. It is informed across the bar that the husband of the applicant has been enlarged on bail by the Court of Magistrate. Since the application is withdrawn, the applicant is being granted protection for one week to enable her to appear before the Magistrate.

7.aba41.15.sxw Learned Counsel submits that the applicant would appear before the Magistrate on or before 27/1/2015. The applicant stands protected till 5 p.m. of 27/1/2015. Learned Magistrate shall not be influenced by the withdrawal of this application and shall consider the application filed by the present applicant under section 437 of the Code of Criminal Procedure, 1973 and decide the same on its own merits.
The application stands dismissed as withdrawn and disposed of accordingly.
