For the reasons stated in the Judgment separate, the following order is passed :-

O R D E R

(i) The Appeal is partly allowed.

Mhi 2 Apeal-642-1996 & REVN-286-96.sxw (ii) The conviction of the appellant for the offence punishable under Section 306 of IPC is quashed and set aside and the appellant is acquitted of the charge under Section 306 of IPC. (iii) The conviction of the appellant for the offence punishable under Section 498A of IPC is maintained.

(iv) The fine amount if paid for the offence under Section 306 of IPC be refunded to the appellant.

(v) Fine amount for the offence under Section 498A of IPC is maintained.

(vi) Bail bonds stand cancelled.
