Learned counsel for Applicant submits that the Revision Application was filed before the Sessions Court and Sessions Court
903-IA-927-2024 (CR).DOC has disposed off the said Application on the ground of non maintainable, thereafter the present Criminal Application is preferred. Learned counsel for the Applicant, on instructions, seeks leave to withdrawn this Application with liberty to file Appeal before the learned Sessions Court.

Considering the submissions of learned counsel for the Applicant as well as in view of the Hon'ble Apex Court in the case of Celestium Financial Vs. Ghanasekaran Etc1, the Application is allowed to be withdrawn with aforesaid liberty.

Criminal Application is dismissed and disposed of as withdrawn.

Learned Sessions Court shall consider the delay, if Appeal is filed as Application was pending before this Court. 6.
In view of disposal of Criminal Application, Interim Application is also disposed off.
