Applicant is seeking regular bail in Crime No. 407/2018 registered with Sangli City Police Station for offence punishable under Sections 4B, 5(3), 5(4) of the Medical Termination of Pregnancy Act, 1971. After arrest on 17/09/2018, applicant was subjected to interrogation and after completion of investigation, chargesheet in the matter is already filed.
2 918.134.19 ba.doc The offence is punishable maximum with five years of imprisonment out of which the applicant has already spent more than four months in jail.
Applicant is a highly qualified person and has deep roots in the society and is very much available for the prosecution to pursue the present case against her.
Husband Vijaykumarco accused is already released on regular bail by this Court vide order dated 09/01/2019 passed in Bail Application No. 3324/2018.
A statement is made by the learned senior counsel Shri. Mundargi on instructions that till the conclusion of trial, the applicant shall not operate her nursing home/hospital or shall not influence any of the witnesses is accepted as an undertaking. Applicant shall, after her release within two weeks, furnish an undertaking to this Court to the aforesaid effect. In view of this
3 918.134.19 ba.doc application for grant of bail is made out. Hence, following order: (A) Applicant be released on bail in Crime No. 407/2018 registered with Sangli City Police Station on furnishing P.R. bond in the sum of Rs. 50,000/ with one or more sureties in the like amount.
(B) Applicant shall furnish her contact number/landline number and permanent place of abode to the Investigating Officer.
(C) Applicant shall not influence witnesses or tamper with evidence.
Application stands disposed of.
