Heard Mr.P.G. Sarda, the learned counsel for the applicant. Heard Mr.A.R. Patil, the learned APP for the State. I have been taken through the copies of the depositions of the witnesses, which copies are annexed to the Appeal Memo. After carefully considering the evidence adduced including the medical evidence and the evidence about the age of the victim, I do not think it fit to direct suspension of the substantive sentences imposed upon the applicant/appellant. However, it would be proper, as submitted by Mr.Sarda to hear the Appeal expeditiously.
Application is rejected.
Tilak 2/2 (907)APPA-83-16 Hearing of the Appeal is ordered to be expedited. Liberty to the applicant to move the Court for getting the date of final hearing of the Appeal fixed, after receipt of Record and Proceedings with paper book.
