This application under Section 24 of Code of Civil Procedure (CPC) is filed by the husband for transfer of Hindu Marriage Petition No.92 of 2013 from the District court, Jalgaon, to the court of Civil Judge, Senior Division, at Karad, for hearing along with Hindu Marriage Petition No.101 of 2013 filed under Section 9 of Hindu Marriage Act for restitution of conjugal rights. avk 1/2

24-MCA-16-2014 The application is made on the ground that the applicant is a physically handicapped person with 100% disability on account of the injuries sustained in an accident. He sustained injury to his spinal chord, and consequently, is unable to take up long travels. He cannot walk and needs a wheelchair for moving. The applicant has annexed the copies of the medical reports to the application, that substantiate his physical condition. Considering the fact that the applicant is a physically handicapped person with 100% disability, the application is allowed in terms of Prayer Clause (a).
