In this writ petition filed under Article 227 of the Constitution of India, the petitioners have assailed the validity of the order dated 25th November, 2009 passed by the Addl. District Judge, Kolhapur in Misc. Civil Appeal No. 193 of 2009 whereby the judgment and order dated 23rd September, 2009, passed by the Civil Judge, Junior Division, Gargoti in RCS No. 63 of 2009 below application Exh. 5, rejecting application for temporary injunction, has been confirmed.

The Regular Civil Suit No. 63 of 2009 has been itself disposed of on 26th November, 2009. The writ petition, therefore, has been rendered infructuous.

Accordingly, the writ petition is dismissed as infructuous. (CHIEF JUSTICE)
