The petitioner's application for temporary injunction has been rejected by the Appellate Court by way of impugned order dated 4 September 2017. Since 4 September 2017 there is no interim relief in favour of the petitioner. Moreover, evidence of the parties has been closed before the Trial Court. Hence, no interference in the impugned order is called for. 2.

However, keeping all questions on merit open to be agitated by the petitioner before the Trial Court at the time of hearing of the suit, the writ petition stands disposed of. No costs. (AMIT BORKAR, J.)
