Applicant is seeking regular bail in Crime No. 563/2018 registered with Phaltan Gramin Police Station for offence punishable under Sections 307, 326 r/w 34 of the Indian Penal Code and Sections 3, 25 and 27 of the Arms Act. Applicant came to be arrested on 31/12/2018 and after the investigation was carried out, it revealed that the only role alleged against the applicant is that of accomplice.

2 18.216.19 ba.doc During investigation, the evidence collected does not depict the prima facie involvement of the applicant in the crime in question. Though Investigating Officer is not present, the learned APP on instructions submits that there are other four accused arrested in the crime where from it revealed that applicant has not played any active role in the crime in question. That being so, case for grant of bail is made out. Hence, following order:

(A) Applicant be released on bail in Crime No. 563/2018 registered with Phaltan Gramin Police Station on furnishing P.R. bond in the sum of Rs. 15,000/­ with one or more sureties in the like amount.

(B) Applicant to attend Investigating Officer as and when directed by Investigating Officer.

Application stands disposed of.
