By this application, the applicant is seeking relaxation of condition imposed on the applicant by this Court (Coram: Anil S. Kilor, J.) vide order dated 2nd July 2024 in Cri. Bail Application No. 2333 of 2023.

It is contention of learned counsel for applicant that this Court imposed the condition on the applicant not to enter the territorial jurisdiction of Kolhapur city till conclusion of the trial except, attending the trial. The applicant is out of Kolhapur city for Iresh

40-IA-308-2025 (CR).DOC more than one year. The applicant's family stays at Kolhapur. Hence, requested to allow the application.

Learned APP alongwith learned counsel for respondent no. 2 strongly objected to allow the application on the ground that if the applicant is permitted to enter Kolhapur city, he may threaten the first informant and prosecution witnesses and requested to reject the application.

I have heard all the learned counsels.

Considering the submissions made by learned counsel for the applicant and reasons mentioned in the application, I pass following order:

O R D E R

I.

The application is allowed.

II.

Condition no. (iii) imposed on the applicant is hereby relaxed. III.

Professional fees of Rs. 10,000/- to be paid to learned counsel appointed through Legal Aid for respondent no. 2. 7.

The application is disposed off above terms.
