The learned APP on instructions from the Investigating Officer has submitted that, a report dated 14.5.2018 under Section 169(3) of the Cr.P.C. has been submitted to the Court of Chief Judicial Magistrate, Kolhapur qua the applicant. A copy of the said report is tended on record. The said report indicates that, there is no evidence available as against the applicant for the alleged commission or showing complicity of the applicant in the present crime.

In view of the report dated 14.5.2018, the apprehension of the applicant of arrest by police does not subsists. In view thereof, the interim relief granted by Order dated 23.1.2018 is confirmed. However, the condition to attend the concerned police station is hereby waived.
