Since charge-sheet in the subject crime is already filed, Mr. Patil, learned counsel for the Applicant seeks leave to withdraw the application with liberty to file discharge application before the trial Court. Leave with liberty as prayed for is granted. Application is allowed to be withdrawn and is dismissed as such. 2.
It is made clear that this Court has not gone into merits of the matter and all points and contentions are kept open. In the event the Applicant files application for discharge, the same shall be decided by the Court below independently, on its own merits and in accordance with law.
