The learned counsel for the applicant fairly submits that in the present case i.e. Sessions Case No.4 of 2016, trial has commenced. In view of this, it would not be appropriate to consider the application under Section 439 of Cr.P.C. in the midst of the trial. The learned Sessions Court, Satara shall proceed with the trial expeditiously.
