Learned counsel for the applicant submits that applicant is behind bar for more than eight years. Yet trial is not concluded. Hence, requested for bail.

It is the contention of learned APP that trial is almost concluded. Matter is posted for arguments tomorrow i.e. 30th September 2025. Learned APP further submitted that Division Bench of this Court (Coram: Ravindra V. Ghuge and Gautam A. Ankhad, JJ.) Iresh 1/2

44-BA-310-2025 (CR).doc by order dated 28th July 2025 has passed the order and directed the Trial Court to proceed with the matter on day to day basis and the time is extended to dispose of the matter by 31st January 2026, but this fact is suppressed by the applicant. 4.

It is the contention of learned counsel for applicant that he did not suppress the order passed by the Division Bench and applicant be permitted to withdraw this application with liberty to file fresh bail application, if trial is not concluded by 31st January 2026.

In view of above, the application is allowed to be withdrawn. 6.

The application is dismissed and disposed of with aforesaid liberty.
