CIVIL APPELLATE JURISDICTION WRIT PETITION NO.6156 OF 2023 Mr. Bhimrao Vitthal Kamble

Versus

Mrs. Archana Bhimrao Kamble

.........

Mr. Wasim Samlewale for the Petitioner.

CORAM : N.R. BORKAR, J.

DATED : 3 AUGUST 2023 P.C. :- In a petition filed by the petitioner/husband for divorce the respondent/wife had filed an application under Section 24 of the Hindu Marriage Act, 1955 for maintenance pendente lite for the daughter and the son at the rate of Rs.20,000/- per month. 2.

The learned Family Court, Sangli rejected the application qua the daughter on the ground that she is major and is thus not entitled to maintenance under Section 24 of the Hindu Marriage Act, 1955. The learned Family Court however directed the petitioner to pay maintenance at the rate of Rs.16,000/- per month, for the son.

3.

Though the maintenance at the rate of Rs.16,000/- appears to be little bit on higher side as Rs.20,000/- was sought for the daughter and the son, however, it appears that the daughter is still studying and the respondent alone is maintaining her. Sayyed 1 / 2

Considering the overall facts and circumstances, I am not inclined to interfere with the impugned order. 5.

The petition is dismissed.
