The offences are under Sections 454, 451, 341, 380 read with 34 of the Indian Penal Code. The Respondents are acquitted in a Police case vide order passed by the Court of JMFC, Kolhapur on 04/09/2003. It is true that it is admitted on 25/01/2006. Prior to the admission of the appeal, Respondents have appeared through learned Advocate Shri Amit Borkar (now elevated as High Court Judge). After admission, notice was issued to both the Respondents. However, the report dated 16/12/2022 given by Juna Rajwada Police Station by SEEMA KSHITIJ YELKAR Date:

5. Apeal 1470 of 2003.doc mentions that the Respondents are not staying on the address. This notice was issued in view of the elevation of their advocate. 2.

Even copies of the station diary entries are annexed. Police have also recorded the statement of one Bhushan Mithari and Prashant Bhosale. They have not aware about such persons. 3.

Since then no steps are taken for serving them. Sufficient time was granted to the prosecution. Today request is made for granting some more time. I am not inclined. Let appeal be dismissed. 4.

Accordingly, appeal is disposed of.
