Heard learned counsel for the applicant and learned APP.

This is an application for pre-arrest bail. The applicant is apprehending arrest in connection with C.R. No.670 of 2022 dated 18/12/2022 registered with MIDC Police Station for offence punishable under sections 306 and 34 of the Indian Penal Code, 1860.

The applicant is a doctor. It is alleged that the applicant had an affair with the wife of the deceased. The
deceased came to know about the affair. He therefore requested his wife that she should not carry on with the affair. The wife of the deceased-co-accused wanted divorce. The deceased committed suicide. The wife of the deceasedco-accused and her relatives have already been released on bail. The allegations mainly are against the wife and her parents. So far as the applicant is concerned, it is alleged that the wife of the deceased was having an affair with him. Considering the nature of the accusations, the custodial interrogation of the applicant is not required. There are no criminal antecedents reported against the applicant. As the wife of the deceased has already been granted pre-arrest bail, the application deserves to be allowed. However, the applicant must have to co-operate with the investigation. Hence, the following order.
O R D E R
(a) The application is allowed.
(b) In the event of arrest of the applicant in connection with C.R.No.670 of 2022 dated 18/12/2022 registered with MIDC Police Station, the applicant-Milind Hemraj Sarode be released
on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;
(c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence;
(d) The applicant shall attend the investigating officer on 30th January 2023 between 11.00 a.m. and 1.00 p.m. and thereafter as and when called for.
