Though the Respondent No.2 is not served, as the Application is only for condonation of delay, this Court has heard learned advocate for the Applicant. Since the date of judgment, Applicant is in jail. There is no one to look after his family members. Applicant therefore could not immediately give instructions to lawyer to file Appeal. After sometime, he could manage to engage a lawyer. It is in this process, delay is caused. Though delay is not stated in the Application, it is 2 years and 4 days as per the calculation. Since this is Application by person in jail, this Court is inclined to allow the Application. 2.
The Application is therefore allowed. Delay of 2 years and 4 days is condoned.
