Heard Mr. Bhangoji, learned Counsel for the petitioner. 2.

The petitioner is challenging the order dated 30th May, 2011 passed by the respondent No.2 - Divisional Caste Certificate Scrutiny Committee No.2 invalidating the caste claim of the petitioner as belonging to "Sonar, Other Backward Class" issued by the Competent Authority and further seeking directions to respondents No.3 and 4 to declare the result of the petitioner of SHAILAJA SHRIKANT HALKUDE SHRIKANT HALKUDE Date: 2025.10.15 09:42:12 +0530

final year of M.D. (Homeopathic) and if the petitioner is found to be successful in the final year, to release the passing certificate as well as original mark-sheets of M.D. (Homeopathic) Post Graduate Course and other original documents which are lying with respondents No.3 and 4.

Learned Counsel for the petitioner submitted that full blood sister of the petitioner - Sulekha Subhash Govekar has been granted Caste Validity Certificate dated 18th June, 1994 by the Scrutiny Committee. Learned A.G.P has opposed the petition. In view of the law laid down by this Court in Apoorva d/o Vinay Nichale Vs. Divisional Caste Certificate Scrutiny Committee No.1 and others1, the petitioner being close blood relative i.e brother of Sulekha Subhash Govekar is entitled to Caste certificate of validity in his favour.

This petition is allowed. The impugned order dated 30th May, 2011 passed by respondent No.2 - Divisional Caste Certificate Scrutiny Committee No.2 is set aside. The Respondent No.2 is directed to issue certificate of validity in favour of the petitioner within a period of four weeks from today. 5.

In the event, any adverse orders are passed by the Committee in respect of the Caste Validity Certificate issued in favour of the petitioner's sister , liberty is open to the respondent No.2 to take further steps against the caste 2010 (6) Mh. L.J, 401

validity certificate issued to the petitioner. 6.

In this view of the matter, respondents No.3 and 4 are directed to declare the result of the petitioner of final year of M.D. (Homeopathic) and if the petitioner is found to be successful in the final year, respondents No.3 and 4 are directed to release the passing certificate as well as original mark sheets of M.D. (Homeopathic) Post Graduate Course and other original documents which are lying with respondents No.3 and 4.
