Mr.Walimbe, learned AGP for the State tenders a copy of the order dated 2nd March, 2015 from the Deputy Director of Education, Kolhapur Division deciding the issue, which was directed to be decided by an order dated 14th September, 2021 if not decided. A copy of the said order is handed over to the learned counsel for the petitioner. In view of the decision already taken by the Deputy Director of Education, the learned counsel for the petitioner seeks liberty to withdraw this petition with liberty to challenge the said decision.

The writ petition is dismissed as withdrawn with liberty as prayed. There shall be no order as to costs.
