The petitioner-original defendant is challenging the order passed by the Appellate Court restraining him from constructing over the suit property. The order of injunction is in force against the petitioner since 29 October 2018. Hence, no interference is called for. The writ petition is dismissed.

However, all contentions raised by the parties are kept open to be agitated at the time of hearing of the suit. 3.

The Trial Court shall decide the suit uninfluenced by the observations made in the impugned order.
