This is an application for condonation of delay in filing an appeal challenging conviction of the applicant/appellant for the offence punishable under Section 307 of the Indian Penal Code. Heard the learned Advocate appearing for the applicant as well as the learned Additional Public Prosecutor appearing for the State.

The applicant is a convict, who is undergoing jail sentence. He is challenging his conviction and resultant sentence Gaikwad RD 1/2

(4)APPANo.1582018 by filing an appeal and as there is delay of 188 days in preferring the said appeal, this application.

Perusal of the application shows that the applicant has shown sufficient cause for seeking condonation of delay. He could not contact his Advocate because he is undergoing the jail sentence. Therefore, the following Order :

ORDER

(i) The application is allowed.

(ii) The delay in preferring the appeal is condoned. (iii) The application is disposed of accordingly.
