Heard the learned counsel for the applicant.

This application is for bringing legal heirs on record of deceased respondent no.2B, Mahadev Bhanudas Mirajkar who died on 24.11.2014.

The learned counsel for the applicant submits that they filed the present Civil Application on 4.2.2015. That is within limitation.

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

a) Civil Application is allowed in terms of prayer clause (a) which read thus:

35 cas1339-15.doc "(a) This application will be allowed in toto and permission granted to the legal heirs of the deceased Respondent No.2B brought on record and title clause of the Appeal memo be amended accordingly."

b) Applicant to carry out appropriate amendment in Second Appeal as well as pending Civil Application if any, within four weeks from today c) Civil application stands disposed off accordingly.
