By this revision application, the applicant seeks to impugn the order dated 16th May, 2006 passed by the Special Land Acquisition Officer No.3, Sangli rejecting the application for condonation of delay in filing reference under section 18 of the Land Acquisition Act, 1984. The Authority has rejected the application of the petitioners without assigning the reasons.

Learned counsel for the petitioners invited my attention to the application made by the petitioners seeking condonation of delay in making reference annexed at Ex.C to the petition. With the assistance of the learned counsel, I have perused the reasons in the application for condonation of delay. This court is satisfied with the reasons recorded in the said application for seeking condonation of delay which in my view are satisfactory and ought to have been considered by the Authority. I, therefore pass the following order :-

kvm 2/2 13-CRA977.10 (a) The impugned order dated 16th May, 2006 passed by the Special Land Acquisition Officer No.3, Sangli rejecting the application for condonation of delay is set aside.

(b) Application for condonation of delay is allowed.

(c) The Land Acquisition Officer is directed to make a reference under section 18 of the Land Acquisition Act, 1984 to the reference court. 3.

Civil revision application is disposed of in the aforesaid terms. No order as to costs.
