None present for the Applicant. This is an Application filed under Section 439(2) of the Code of Criminal Procedure, by the first informant for cancellation of pre-arrest bail granted to accused no.1 in C.R.No. 76/2016 registered at Panhala Police Station. 2.

Learned APP also states that the charge sheet has already been filed before JMFC, Panhala on 10/07/2017 and that the case is registered as Case No.67/2017. It is stated that the charge has been framed and that the trial has already commenced, though the same could not be concluded due to the situation arising from COVID-19 pandemic.

I have perused the records. The order of bail is not perverse and does not suffer from infirmities. The Respondent has not misused the liberty nor attempted to thwart the course of justice. No grounds are made out to cancel the bail.

Under the circumstances, the Application has no merits and is dismissed.
