Applicant is seeking his enlargement on bail in Crime No. 602 of 2019 registered with Mohol Police Station, Solapur for the alleged offences punishable under Sections 307, 354, 452, 323, 504, 506 of the Indian Penal Code, 1860 ( IPC for "

Investigation in the case is over and the final report has been filed. I have perused it. 3.

Besides the complainant, there are four eye witnesses who had seen the alleged incident of

Najeeb 2/2 16.BA-480-2020 assault. The injured had suffered fracture of right frontal bone which was certified as a grievous injury by the Medical Officer. In view of evidence available on record and since the offence is punishable with imprisonment for life, the application is rejected.

At this stage, learned counsel for the applicant submits that if the trial does not commence on or before 31st March, 2021, he may be granted liberty to apply seeking his enlargement on bail. Liberty granted. Application is disposed off accordingly.

It is made clear that the observations made hereinabove shall be construed as expression of opinion only for the purpose of refusal of bail and the same shall not in any way influence the trial in other proceedings.
