1) It is an admitted fact on record that, on three occasions when the Petitioner was released either on parole or furlough leave, reported late to the Jail Authority. It appears that, on each occasion the Petitioner did not comply with the directions issued by the Jail Authority and reported late by substantial period.
2) In the year 2016 CR No. 263 of 2016 under Section 224 of the Indian Penal Code has also been registered with Walchand Nagar Police Station, as the Petitioner did not report to the Jail Authority within stipulated period and was reported to be absconding.

Osk 38-Ia-196-2024.doc 3) According to us, the Petitioner did not deserve any sympathy or leniency by this Court, for his said conduct. 4) Petition being dehors of merits is accordingly dismissed. 5) In view of dismissal of Petition, Interim Application No. 196 of 2024 pending therein does not survive and is accordingly disposed off.
