In view thereof and after this Court expressed its disinclination to grant relief to the Appellant at this stage, Mr. Redekar learned counsel, on instructions, seeks leave to withdraw the present Appeal with liberty to file a fresh Application for bail before the Trial Court after the Investigating Officer submits a report under Section 173(2) or a stage under Section 167(2) of Cr.P.C. arises.

Leave and liberty granted.
