This is an application under Section 438 of the Cr.P.C. filed by the aforesaid Applicants apprehending their arrest in C.R. No.193 of 2015 registered with Vijapur Naka Police Station, District -Solapur, for the offences punishable under Sections 353, 379, 506 r/w 34 of the IPC.

Heard Mr. Ritesh Thobde, learned counsel for the Applicants and Mr. Shrikant Yadav, learned APP for the Respondent - State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 1/3

Considering the fact that charge-sheet has been filed, this Court by order dated 7/2/2023 granted interim protection to the Applicants with directions to report to the Investigating Officer. Learned APP states that the Applicants have complied with the directions and that they have been interrogated. 4.

Considering the above facts and circumstances, the interim order dated 07/02/2023 is confirmed. Hence, the application is allowed on the following terms and conditions :- (i) In the event of arrest of the Applicants in C.R. No.193 of 2015 registered with Vijapur Naka Police Station, District -Solapur, the Applicants shall be released on bail on furnishing PR bonds in the sum of Rs.25,000/- each with one or two sureties each to the like amount;

(ii) The Applicants shall report to the Investigating Officer as and when required by the Investigating Officer;

(iii) The Applicants shall not tamper with the prosecution evidence and or influence the witnesses in any manner.

(iv) The Applicants shall keep the Investigating Officer informed of their current address and mobile contact numbers, and /or change of residence or mobile details, if any, from time to time.
