Heard Mr. Tajane, learned Advocate for Petitioners; Mr. Chavan, learned Advocate for Respondent No.1 and Mrs. Nimbalkar, learned AGP for Respondent - State.

The present Writ Petition seeks to challenge the order of remand passed by the Divisional Joint Registrar dated 26.11.2019 in Revision Application No.192 of 2018 wherein the Assistant Registrar has been directed to determine the eligibility of 11 Petitioners before the Court afresh.

During the pendency of the present Petition which was filed in the year 2020, by interim order dated 13.02.2024 the Assistant Registrar was directed to determine the eligibility of the Petitioners.

Learned Advocates across the bar informed the Court jointly that eligibility of Petitioner Nos.2, 4, 8, 9, 10 and 11 has been determined and they have been declared as eligible for membership of Respondent No.1 - Society.

It is also informed across the bar that Petitioner No.7 has expired during the interregnum whereas Respondent No.6 was deceased at the time of filing of the Petition. It is next informed that in so far as Petitioner Nos.1, 3 and 5 are concerned, their eligibility has been rejected and they have been held to be ineligible by the order passed by the Assistant Registrar of Co-operative Societies. 6.

If Petitioner Nos.1, 3 and 5 are aggrieved with the said order, they can exercise their remedy and file appropriate Appeal before the appropriate forum and challenge the said order. In so far as prayer clauses 'a' and 'b' in the present Petition are concerned, they do not survive in view of the facts of the case. 7.

Needless to state that once the eligibility of the Petitioners has been decided by the Assistant Registrar, Respondent No.1 - Society shall accept them as Members and complete all the formalities as required in accordance with law.
