The petitioner was purchaser of the property and during pendency of the writ petition the appeal has been disposed of and the second appeal is pending. It is informed that the petitioner has filed similar application under Order 1, Rule 10 of the Code of Civil Procedure, 1908 in the second appeal. Disposal of the present petition shall not be impediment for adjudicating the application filed by the petitioner before this Court in second appeal. 2.
