.....

Mr. Abhijeet J. Kandarkar, for the Petitioner. Ms. Vaishali Nimbalkar, AGP, for the Respondents. ......

CORAM : S.C. GUPTE, J.

DATED: 14 AUGUST, 2018 P.C. :

.

The contempt petition alleges breach or disobedience of the order passed by this Court on 5 April 2016. The order requires the Respondent State to grant approval to the appointment of the Petitioner as a trained teacher with effect from the date of appointment. Since the State granted its approval from the date of the order instead of from the date of the appointment, this contempt petition has been filed by the Petitioner alleging breach of the order. Learned AGP produces an order issued by the Education Officer (Secondary) Zilla Parishad, Sangli, rectifying the mistake and granting approval to the appointment of the Petitioner from the date of appointment. The order is taken on record, marked "X" for identification. Accordingly, the Petitioner's grievance does not survive and he does not press the petition. The petition is disposed of as not pressed. The State is directed to process the matter of payment Pg 1 of 2

cp7417.doc of salary to the Petitioner in accordance with the order of this Court and the corrigendum issued by the State as expeditiously as possible. The school management shall also cooperate in the matter and expeditiously comply with the requisitions of the Education Office in this behalf. Digitally signed by Smita Johnson Gonsalves Date:
