Heard learned counsel for the Appellant and learned APP for the Respondent-State.

Mr.Arjun Lingalod, of Legal Aid Panel is appointed to represent Respondent No.2.

It is contention of the learned counsel for the Appellant that, the Appellant is on interim relief since 16th March 2020. He has co-operated in the investigation. The investigation is completed. Hence, requested to allow the Appeal. 4.

No.2 strongly objected to allow the Appeal on the ground that, the Appellant has assaulted the first informant and abused him on his caste.

I have heard all learned counsel. Perused FIR and documents produced on record.

It is prosecution's case that, on 25th August 2019 around 11.00 a.m. the first informant was working in his farm, at that time, Appellant and co-accused came there and abused the first informant on his caste in filthy language. The offence registered against the Appellant under Section 504 and 506 read with Section 34 of the Indian Penal Code ('IPC' for short) and Sections Sections 3(1)(r), 3(1)(s), 3(2)(va) read with Section 6 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 ('SCST Act' for short). 7.

This Court (Coram : A.M. Badar, J.) by reasoned order has granted ad-interim relief on 16th march 2020 to the Appellant. Since then, the Appellant is on interim relief. The Appellant has co-operated in the investigation. The allegations against the Appellant are in chorus and Appellant is on interim N.S. Kamble page 2 of 3

relief for around five years.

Considering these facts, custodial interrogation of the Applicant is not required.

In such circumstances, the Criminal Appeal is allowed and disposed of in terms of the order dated 16th March 2020.

All pending Applications are disposed of.

The learned counsel for Respondent No.2 is appointed by this Court, he is entitled for fees as per provisions of the legal services.
