In crime No.363/2018 for offence punishable under sections 307, 324, 323, 504, 506, 143, 144, 145, 147, 148 and 149 of the Indian Penal Code and section 135 of the Bombay Police Act registered with Shahuwadi police station, District Kolhapur, the applicant is seeking prearrest bail.

There is a cross complaint as can be inferred from crime No.362/2018 for the offence punishable under sections 307, 324, 323, 504, 506, 143, 144, 145, 147, 148 and 149 of the Indian Penal

No specific role is attributed to the applicant in the crime in question which warrants his custodial interrogation. A case for prearrest bail is made out. Hence the order : i) In the event of arrest in Crime No.363/2018 for the offences punishable under sections 307, 324, 323, 504, 506, 143, 144, 145, 147, 148 and 149 of the Indian Penal Code and section 135 of the Bombay Police Act registered with Shahuwadi police station, District Kolhapur, the applicant be released on bail on his executing P.R. bond of Rs.25,000/ with one or more sureties in the like amount;
ii) The applicant shall attend the Investigating officer as and when directed;
iii) The applicant shall not influence the prosecution witnesses or tamper with the evidence;
iv) The applicant shall cooperate with the investigating agency; v) The application stands disposed of accordingly. (NITIN W. SAMBRE, J.)
