Having regard to the reasons mentioned in the impugned order dated 15­11­2014 passed by the Learned Civil Judge Junior Division, Akkalkot, no case for interference in the Writ Jurisdiction of this Court is made out. However, though the issue of limitation is to be tried along with the other issues, the Trial Court may consider trying the issue of limitation at the threshold and try the other issues thereafter so that the parties know where they stand.
