Heard learned Counsel for the petitioner.

It was brought to the notice of the learned Counsel for the petitioner that the Caste Validity Certificate is not challenged, in the absence of which, no effective reliefs can be granted. Learned Counsel seeks leave to withdraw the petition with liberty to file a fresh petition challenging the Caste Validity Certificate which will require comprehensive pleadings. 3.
The petition is allowed to be withdrawn with liberty as prayed for. The petition is disposed of as withdrawn.

It is made clear that we have not examined any of the contentions raised in this petition on merits. It is open for the petitioner to challenge the Caste Validity Certificate issued in favour of the concerned incumbent with which the petitioner is aggrieved. It is open for the petitioner to raise all contentions which are subject mater of the present petition in the freshly filed petition challenging the Caste Validity Certificate.
