The Trial Court by the impugned order rejected petitioners' application under Order 7 Rule 11, Section 9A of the Code of Civil Procedure Code, 1908 and Section 69 of the Indian Partnership Act, 1932. All questions raised being questions of facts and law, it shall be open for the petitioners to raise all the issues at the time of hearing of the suit. Hence, no interference at this stage is called for.

Hence, keeping all contentions raised by the petitioner open to be agitated before the Trial Court at the time of hearing of the suit, the writ petition stands disposed of. No costs. (AMIT BORKAR, J.)
