By the impugned order, the Joint Charity Commissioner has allowed the revision application filed by respondent No.3. Challenge in the revision application was to the order of condonation of delay passed by the Deputy Charity Commissioner. The Joint Charity Commissioner observed that before condonation of delay, the respondent No.3 was not heard. On that ground, in my opinion, the Joint Charity Commissioner was justified in remanding proceedings back to the Deputy Charity Commissioner. 2.

The Deputy Charity Commissioner shall decide the application for condonation of delay on its own merit. With this clarification, the writ petition stands disposed of. No costs. (AMIT BORKAR, J.)
