Heard Mr. Chaudhary, the learned Counsel for the appellant.

Mr. Chaudhary, on instructions, seeks leave to withdraw the appeal, provided the trial in Special Case No.40 of 2020 pending on the fle of the learned Special Judge, Pandharpur, is expedited.

We fnd the request for expeditious conclusion of the trial reasonable.

The appeal, thus, stands dismissed as withdrawn. 5.

The learned Special Judge, Pandharpur, is requested to 1/2

21-CRIAPEAL157-2021.DOC make an endeqvour to complete the trial in Special Case No.40 of 2020 as expeditiously as possible and, preferably, within a period of nine months from the date of the communication of this order.

In the event, the trial is not concluded within the aforesaid period, the appellant shall be at liberty to revive the prayer for grant of bail.

We make it clear that we have not entered into merits of the matter.
