That for the reasons stated in para-4 of the Civil Application, the delay of 158 days occurred in filing the Civil Application is condoned and the order of abatement as against deceased respondent no.1(b) is set aside. The applicant is directed to carry out amendment within 14 days from today and serve a copy of the amended petition on the respondents. The application is allowed in terms of prayer clauses (a), (b) and (c).
