P.C. :- By this Application the Applicant - State seeks leave to file Appeal against the Judgment of the Additional Sessions Judge, City Civil and Sessions Court, Greater Mumbai, dated 12.8.2014, acquitting the Respondent for offence punishable under Section 302, 397 and 452 r/w. 34 of the Indian Penal Code and under Section 37(1) r/w. 135 of the Bombay Police Act.

We have heard the learned APP in support of the various grounds urged in the Application. With the assistance of the learned APP, we have perused the findings recorded by the Trial Court. Upon such perusal, in our opinion, this is a fit case for granting leave.

We accordingly allow this Application and grant leave as prayed for. Criminal Appeal filed by the State stands admitted.
