Present writ petition takes exception to order dated 30th January 2025, passed by learned Civil Judge, Senior Division, Sangli below Exhibit 10 in Regular Civil Suit No.435 of 2024, thereby rejecting the application of petitioners / plaintiffs seeking appointment of Court Commissioner.

The writ petition was posted on board for admission on 28th April 2025. However, none appeared for petitioners. Accordingly, it was adjourned to 16th June 2025, with a clarification that pendency of writ petition shall not be impediment for proceeding

25 - WP - 5442 - 2025 .doc of the suit. The writ petition was then posted on board dated 11th September 2025, after it has been transferred to Circuit Bench at Kolhapur. Even on that day, none appeared for petitioners. Therefore, matter was adjourned and taken up on today's board. Today also, none appears for petitioners. It is, therefore, apparent that petitioners are not interested in prosecuting writ petition. 3.

In result, writ petition stands dismissed for want of prosecution.
