P.C.:- 1) By this Petition, the Petitioner seeks a direction to take cognizance/action against the Respondent No.1 on the basis of the Petitioner's complaints dated 1st December 2022 and 31st March 2022 as well as other villagers. The Respondent No.1 is the Senior Inspector of Police attached to Mangalvedha Police Station, Solapur. 2) Learned APP raises a preliminary objection. He states that since complaints have been made against Police officers, the Petitioner has an alternate efficacious remedy of filing the complaints before the Divisional Police Complaints Authority or the State Police Complaints Authority, as the case may be.

33-wp-3352-2023.doc 3) In view of the objection raised by the learned APP, learned counsel for the Petitioner does not press the Petition and seeks leave to withdraw the same with liberty to file appropriate complaints before the Divisional Police Complaints Authority or the State Police Complaints Authority, as the case may be. If the said complaints are made, the said Authority to decide the same expeditiously. 4) With the aforesaid observations, the Petition is disposed off as withdrawn with liberty as prayed for.

5) We make it clear that we have not heard the Petition on merits vis-a-vis the allegations made by the Petitioner against the Respondent No.1 i.e. Senior Inspector of Police attached to Mangalvedha Police Station, Solapur and as such, all contentions of all the parties are kept open.
