Learned counsel for the petitioner submits that the petition is rendered infructuous, in view of the order dated 17th January 2022, passed by the learned Judicial Magistrate, First Class, Peth Vadgaon, Kolhapur, below Exhibit-1, in C.R. No.19 of 2020 registered with the Vadgaon Police Station, Kolhapur.

Learned counsel for the petitioner has tendered a xerox copy of the said order dated 17th January 2022. The 1/2

6.WP.1300.20.odt said order is taken on record. The operative part of the said order reads thus :

"ORDER

1. Report submitted by Police Station, Vadgaon under section 173(1) of Code of Criminal Procedure is accepted.

2. NC Final Summary is granted.

3. The case proceeding be sent to the concerned Police Station after taking relevant entries in the register."

In view of the order passed by the learned Judicial Magistrate, First Class, Peth Vadgaon, Kolhapur, nothing survives for further consideration in this petition. 4.

Petition is accordingly disposed of.

It is made clear that we have not gone into the merits of the case.

All parties to act on the authenticated copy of this order.
