Heard. The petition is filed for transfer of the investigation in C.R.No. 147 of 2013. It is not disputed that after completion of investigation chargesheet is filed, charge is framed and trial has commenced. In the circumstances the petition is not maintainable. 2.

Mr. Purwant, learned Counsel for the petitioner makes a grievance that statement of the relevant witnesses are not recorded. 3.

The petitioners are always at liberty to furnish the names of pps

902 wp 788-15.doc the relevant witnesses to the Investigating Officer and file appropriate application before the Investigating Officer. The Investigating Officer, if satisfied, is at liberty to file application under Section 173(8) of Cr.P.C.

Subject to above, petition is dismissed.
