This contempt petition is filed seeking an action under the Contempt of Court Act against Respondent No.4 for committing breach of the order dated 6 February 2020.

By order dated 6 February 2020, the Division Bench disposed of Writ Petition No.4323/2019 directing Respondent No.4 to treat the writ petition as representation and pass necessary orders within a period six weeks. While directing to treat the writ petition as representation the Division Bench observed that the petition was bereft of particulars.

The affidavit in reply is filed placing on record that Respondent No.4 has taken a decision on 16 September 2022. As regards delay in taking decision, an unconditional apology is tendered with an explanation that delay occurred due to the situation brought about by Covid-19 pandemic. This reasons cannot be considered as unacceptable.

Now since the order is complied with as the decision is taken and cogent explanation is given for delay, we do not intend to proceed in contempt jurisdiction.

It is always open to the Petitioner, if aggrieved by the decision, to take appropriate steps as per law. 6.
