Mr. Ingale states that the parties have settled the dispute by executing the Memorandum of Understanding dated 3rd July 2023. He states that accordingly the Appellant has given written communication dated 19th July 2023 to withdraw the Second

7 SA 193.2007.doc Appeals. The said communication dated 19th July 2023 of the Appellant as well as copy of said Memorandum of Understanding dated 3rd July 2023 are taken on record and marked 'X' and 'X1' respectively for identification. 3.

Accordingly, the Second Appeals are allowed to be withdrawn and dismissed as such.

In view of dismissal of the Second Appeals, the Civil Application, if any, also stands dismissed.
