1] Heard. Though served and in-spite of repeated chance given to the non-applicant, none appears.
2] Transfer of the divorce proceedings is sought by wife from Family Court at Bandra to Civil Judge, Senior Division, Ratnagiri on the ground of hardship.
3] The marriage took place on 10/10/2013.
4] It is brought to my notice that non-applicant husband is already 1/2
3.101.2020 mca.doc attending Domestic Violence Act proceedings bearing Application No. 32 of 2019 in the Court of Judicial Magistrate First Class, Ratnagiri. 5] It is informed that the two way distance between Bandra and Ratnagiri is around 800 Kms.
6] The contentions in the application are not controverted since non-applicant husband has chosen not to appear. 7] In the aforesaid background, applicant-wife has made out a case for more hardship.
8] In that view of the matter, present application is allowed in terms of prayer clause (b) which reads thus:
"(b) this Hon'ble Court be pleased to transfer of Hindu Marriage Petition No. A-100280 of 2019 from the fle of Ld. 5th Family Court, Bandra, Mumbai to the Court of Ld. Civil Judge, Senior Division, Ratnagiri", [NITIN W. SAMBRE, J.] 2/2
