After the petition was heard for some time, Mr. Kenjale on instructions stated, on without prejudice basis that if petitioner would pay a sum of approximately Rs.16,53,975/- immediately, Respondent No.5 may consider regularizing the loan. Mr. Kenjale also submitted that this court should not stop possession being taken of the mortgaged premises. Mr.Navaneetha Krishnan T on instructions stated that some time should be given to petitioner to at least approach Respondent No.5 and try to work out a schedule of payment of even this Rs.16,53,975/-. 2.

We are therefore disposing the petition with the following order :

(b) Today Respondent No.5 may go ahead to take possession but they shall take only symbolic possession. (c) Respondent No.5 may take physical possession after four weeks if petitioner and Respondent No.5 are unable to bring out amicable settlement.

We clarify that we have not made any observations on the merits of the matter.
